It makes sense to start with what happens when I first speak with an accident victim or their family.
Victims or their families are typically shocked that the police report isn't favorable. I tell them that just because the accident report doesn't favor them, that does not mean they do not have a case against the individual or party that caused the injuries.
You have to remember that the police simply note the facts - they typically do not render any personal opinions about the incident. It's what happens after the conclusion of the accident that matters - and that includes having an aggressive attorney getting involved to help with your situation.
I've found that most people are hit by a car because the driver was distracted. Perhaps they were fiddling with the radio or talking on their cell phone. And at the beginning of a case, you really don't know.
You'll typically find out later....after your attorney has conducted a thorough investigation.
If there is a death involved, the police immediately conduct an accident reconstruction and detail the entire incident.
They'll note characteristics of any skid marks and photograph any damage to the car or truck. And they will conduct extensive interviews with all witnesses.
