In Kentucky, a wrongful or accidental death claim is made to recover damages for the losses that the surviving family and/or estate have suffered due to the death of a loved one. Most cases are brought by a surviving spouse, parent, or child of the victim.
If you've lost a love one, you are entitled to recover the deceased's projected income over their lifetime.
If a spouse is left behind, they can recover additional damages by having the attorney pursue "loss of consortium" - a fancy term meaning the spouse has lost the companionship of that person.
If there are surviving children, they too can recover damages under "loss of consortium".
